text-decoration:none;text-underline:none\"><span style=\"mso-list:Ignore\">(c)<span style=\"font:7.0pt &quot;Times New Roman&quot;\">&nbsp; <\/span><\/span><\/span><\/span> <span style=\"text-decoration: underline;\"><span style=\"color:blue\">The intent of this subsection is to facilitate the<br \/>\novertaking of slowly moving vehicles by faster vehicles, and shall not require<br \/>\nthe drivers of such slowly moving vehicles to risk their own safety in order to<br \/>\nfacilitate overtaking. If there is a marked bicycle lane at the right side of<br \/>\nthe road, operators of bicycles shall not be required to use such lane.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top:0in;margin-right:0in;margin-bottom:6.0pt; margin-left:40.5pt;text-indent:-27.0pt;mso-list:l3 level1 lfo4;tab-stops:list 0in; text-autospace:ideograph-numeric\"> <span style=\"mso-fareast-font-family: &quot;Courier New&quot;\"><span style=\"mso-list:Ignore\">(d)<span style=\"font:7.0pt &quot;Times New Roman&quot;\">&nbsp;<br \/>\n<\/span><\/span><\/span> Upon any roadway having four or more lanes for<br \/>\nmoving traffic and providing for two-way movement of traffic, no vehicle shall<br \/>\nbe driven to the left of the center line of the roadway, except when authorized<br \/>\nby official traffic-control devices designating certain lanes to the left side<br \/>\nof the center of the roadway for use by traffic not otherwise permitted to use<br \/>\nsuch lanes, or except as permitted under subsection (a) 2. This subsection<br \/>\nshall not be construed as prohibiting the crossing of the center line in making<br \/>\na left turn into or from an alley, private road or driveway.<\/p>\n<p class=\"Justifications\">Specific justifications for \u00a7 11-301 changes:<\/p>\n<p class=\"Justifications\">This section is being expanded to include all<br \/>\nslow-moving vehicles. The changes enhance safety and clarity. An operator of a<br \/>\nbicycle, moped or motorcycle can facilitate overtaking in a wide lane while<br \/>\nstill maintaining a position in the lane which maintains visibility and avoids<br \/>\npotential hazards. Section (b) 3 applies to situations where the right-hand<br \/>\nlane is obstructed or unsafe, or is a right-turn lane, or is to the right of a<br \/>\nright-turn lane. <\/p>\n<hr \/>\n<h3 style=\"margin-top:0in;page-break-before:always;mso-list:l0 level3 lfo1\">\u00a7<br \/>\n11-303 Overtaking a vehicle on the left<\/h3>\n<p class=\"MsoNormal\">The following rules shall govern the overtaking and passing<br \/>\nof vehicles proceeding in the same direction, subject to those limitations,<br \/>\nexceptions and special rules hereinafter stated:<\/p>\n<p class=\"MsoNormal\" style=\"margin-top:0in;margin-right:0in;margin-bottom:6.0pt; margin-left:40.5pt;text-indent:-27.0pt;mso-list:l17 level1 lfo18;tab-stops: list 0in;text-autospace:ideograph-numeric\"> <span style=\"mso-fareast-font-family:&quot;Courier New&quot;\"><span style=\"mso-list:Ignore\">(a)<span style=\"font:7.0pt &quot;Times New Roman&quot;\">&nbsp; <\/span><\/span><\/span> The<br \/>\ndriver of a vehicle overtaking another vehicle proceeding in the same direction<br \/>\nshall pass at a safe distance to the left of the vehicle being overtaken and<br \/>\nshall not again drive to the right side of the roadway until safely clear of<br \/>\nthe overtaken vehicle.<\/p>\n<p class=\"MsoNormal\" style=\"margin-top:0in;margin-right:0in;margin-bottom:6.0pt; margin-left:40.5pt;text-indent:-27.0pt;mso-list:l17 level1 lfo18;tab-stops: list 0in;text-autospace:ideograph-numeric\"> <span class=\"UnderlineBlue\"><span style=\"mso-fareast-font-family:&quot;Courier New&quot;; text-decoration:none;text-underline:none\"><span style=\"mso-list:Ignore\">(b)<span style=\"font:7.0pt &quot;Times New Roman&quot;\">&nbsp; <\/span><\/span><\/span><\/span> Except<br \/>\nwhen overtaking and passing on the right is permitted, the driver of an<br \/>\novertaken vehicle shall <span style=\"color: red;\"><del>give way to the right in<br \/>\nfavor of the overtaking vehicle on audible signal and <\/del><\/span>not increase the<br \/>\nspeed of the vehicle until completely passed by the overtaking vehicle.<span style=\"text-decoration: underline;\"><span style=\"color:blue\"> If the roadway is of sufficient width to permit safe<br \/>\npassing, the overtaken driver shall not unnecessarily obstruct the overtaking<br \/>\nvehicle.<\/span><\/span><\/p>\n<p class=\"Justifications\">Specific justifications for \u00a7 11-303 changes:<\/p>\n<p class=\"Justifications\">The current language in part (b) requiring an audible<br \/>\nsignal is an antiquated leftover from the days of Model T Fords and dirt roads.<br \/>\nThen, people drove towards the center of such roads to avoid ruts at the edge.<br \/>\nA faster driver would signal with the horn to alert the leading driver to move<br \/>\nover. On modern roads, people normally drive near the right; therefore this<br \/>\ninstruction has little meaning. Occupying a lane is not unnecessarily<br \/>\nobstructive if another lane is available for travel. Use of horns must be<br \/>\nreserved for emergency situations, not to intimidate or startle slower drivers,<br \/>\nand avoiding noise pollution. <\/p>\n<hr \/>\n<h3 style=\"page-break-before:always;mso-list:l0 level3 lfo1\">\u00a7<br \/>\n11-307-No-passing zones<\/h3>\n<p class=\"MsoNormal\" style=\"margin-top:0in;margin-right:0in;margin-bottom:6.0pt; margin-left:.5in;text-indent:-.25in;mso-list:l12 level1 lfo13;tab-stops:list 0in; text-autospace:ideograph-numeric\"> <span style=\"mso-fareast-font-family: &quot;Courier New&quot;\"><span style=\"mso-list:Ignore\">(a)<span style=\"font:7.0pt &quot;Times New Roman&quot;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span> The (State highway commission) and local<br \/>\nauthorities are authorized to determine those portions of any highway under<br \/>\ntheir respective jurisdictions where overtaking and passing or driving on the<br \/>\nleft side of the roadway would be especially hazardous and may by appropriate<br \/>\nsigns or markings on the roadway indicate the beginning and end of such zones.<\/p>\n<p class=\"MsoNormal\" style=\"margin-top:0in;margin-right:0in;margin-bottom:6.0pt; margin-left:.5in;text-indent:-.25in;mso-list:l12 level1 lfo13;tab-stops:list 0in; text-autospace:ideograph-numeric\"> <span style=\"mso-fareast-font-family: &quot;Courier New&quot;\"><span style=\"mso-list:Ignore\">(b)<span style=\"font:7.0pt &quot;Times New Roman&quot;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span> When such signs or markings are in place and<br \/>\nclearly visible to an ordinarily observant person every driver of a vehicle<br \/>\nshall obey the directions thereof.<\/p>\n<p class=\"MsoNormal\" style=\"margin-top:0in;margin-right:0in;margin-bottom:6.0pt; margin-left:.5in;text-indent:-.25in;mso-list:l12 level1 lfo13;tab-stops:list 0in; text-autospace:ideograph-numeric\"> <span style=\"mso-fareast-font-family: &quot;Courier New&quot;\"><span style=\"mso-list:Ignore\">(c)<span style=\"font:7.0pt &quot;Times New Roman&quot;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span> Where signs or markings are in place to define a<br \/>\nno-passing zone as set forth in paragraph (a) no driver shall at any time drive<br \/>\non the left side of the roadway within such no-passing zone or on the left side<br \/>\nof any pavement striping designed to mark such no-passing zone.<\/p>\n<p class=\"MsoNormal\" style=\"margin-top:0in;margin-right:0in;margin-bottom:6.0pt; margin-left:.5in;text-indent:-.25in;mso-list:l12 level1 lfo13;tab-stops:list 0in; text-autospace:ideograph-numeric\"> <span style=\"mso-fareast-font-family: &quot;Courier New&quot;\"><span style=\"mso-list:Ignore\">(d)<span style=\"font:7.0pt &quot;Times New Roman&quot;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span> This section does not apply under the conditions<br \/>\ndescribed in 11-301(a)2, nor to the driver of a vehicle turning left into or<br \/>\nfrom an alley, private road or driveway.<\/p>\n<p class=\"MsoNormal\" style=\"margin-top:0in;margin-right:0in;margin-bottom:6.0pt; margin-left:.5in;text-indent:-.25in;mso-list:l12 level1 lfo13;tab-stops:list 0in; text-autospace:ideograph-numeric\"> <span class=\"UnderlineBlue\"><span style=\"mso-fareast-font-family:&quot;Courier New&quot;; color:windowtext;text-decoration:none;text-underline:none\"><span style=\"mso-list:Ignore\">(e)<span style=\"font:7.0pt &quot;Times New Roman&quot;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<br \/>\n<\/span><\/span><\/span><\/span> <span class=\"UnderlineBlue\">Division (<\/span><span class=\"UnderlineBlue\"><span style=\"color:red\">c<\/span>) of this section does not<br \/>\napply when all of the following apply:<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top:0in;margin-right:0in;margin-bottom:6.0pt; margin-left:60.75pt;text-indent:-.25in;mso-list:l21 level2 lfo22;tab-stops: list 0in;text-autospace:ideograph-numeric\"> <span class=\"UnderlineBlue\"><b style=\"mso-bidi-font-weight:normal\"><span style=\"font-size:10.5pt;mso-bidi-font-size:10.0pt;mso-fareast-font-family:&quot;Courier New&quot;; text-decoration:none;text-underline:none\"><span style=\"mso-list:Ignore\">1.<span style=\"font:7.0pt &quot;Times New Roman&quot;\">&nbsp; <\/span><\/span><\/span><\/b><\/span> <span style=\"text-decoration: underline;\"><span style=\"color:blue\">The slower vehicle is proceeding at less than half the<br \/>\nspeed of the speed limit applicable to that location.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top:0in;margin-right:0in;margin-bottom:6.0pt; margin-left:60.75pt;text-indent:-.25in;mso-list:l21 level2 lfo22;tab-stops: list 0in;text-autospace:ideograph-numeric\"> <span class=\"UnderlineBlue\"><b style=\"mso-bidi-font-weight:normal\"><span style=\"font-size:10.5pt;mso-bidi-font-size:10.0pt;mso-fareast-font-family:&quot;Courier New&quot;; text-decoration:none;text-underline:none\"><span style=\"mso-list:Ignore\">2.<span style=\"font:7.0pt &quot;Times New Roman&quot;\">&nbsp; <\/span><\/span><\/span><\/b><\/span> <span style=\"text-decoration: underline;\"><span style=\"color:blue\">The faster vehicle is capable of overtaking and passing the<br \/>\nslower vehicle without exceeding the speed limit.<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top:0in;margin-right:0in;margin-bottom:6.0pt; margin-left:60.75pt;text-indent:-.25in;mso-list:l21 level2 lfo22;tab-stops: list 0in;text-autospace:ideograph-numeric\"> <span class=\"UnderlineBlue\"><b style=\"mso-bidi-font-weight:normal\"><span style=\"font-size:10.5pt;mso-bidi-font-size:10.0pt;mso-fareast-font-family:&quot;Courier New&quot;; text-decoration:none;text-underline:none\"><span style=\"mso-list:Ignore\">3.<span style=\"font:7.0pt &quot;Times New Roman&quot;\">&nbsp; <\/span><\/span><\/span><\/b><\/span> <span style=\"text-decoration: underline;\"><span style=\"color:blue\">There is sufficient clear sight distance to the left of the<br \/>\ncenter or center line of the roadway to meet the overtaking and passing provisions<br \/>\nof sections 11-305 and 11-306, considering the speed of the slower vehicle.<\/span><\/span><\/p>\n<p class=\"Justifications\">Specific justifications for \u00a7 11-307 changes:<\/p>\n<p class=\"Justifications\">Overtaking slow vehicles does not require as much<br \/>\ndistance as overtaking vehicles traveling near the speed limit. In particular,<br \/>\nit is often only necessary to merge partway into the oncoming lane to overtake<br \/>\na bicyclist, and so the distance required for overtaking is even shorter then.<br \/>\nSuch overtaking is common and has not been shown to be a problem. Ohio, Maine<br \/>\nand New Jersey have adopted provisions to make this legal. This change is<br \/>\nnecessary for safe and legal passing distances on many roads. The wording is<br \/>\nfrom Ohio statute, and is also relevant to farm equipment and animal-drawn<br \/>\nvehicles. Language added to \u00a711-601(a) will<br \/>\nhelp prevent the dangerous error called the \u201cright hook\u201d. This is similar to <a href=\"https:\/\/dmv.ca.gov\/pubs\/vctop\/d11\/vc21717.htm#_blank\">California CVC \u00a7<br \/>\n21717<\/a>. <\/p>\n<p class=\"Justifications\">Reorganization of the section clarifies that standard<br \/>\nrules for left turns, as well as the option to specify special rules, apply to<br \/>\nall vehicles. Also see section 11-1208, which describes<span style=\"mso-spacerun:yes\">  <\/span>the two-step left-turn option for bicyclists.\n<\/p>\n<hr \/>\n<h3 style=\"mso-list:l0 level3 lfo1\">\u00a7 11-505&#8211;Pedestrians to use right half of<br \/>\ncrosswalks and shared-use paths.<\/h3>\n<p class=\"p61\" style=\"margin-left:.5in\"><span style=\"mso-bidi-font-size:10.0pt; font-family:&quot;Courier New&quot;;mso-fareast-font-family:Times\">Whenever practicable,<br \/>\npedestrians shall move upon the right half of crosswalks<span style=\"text-decoration: underline;\"><span style=\"color:blue\"> and shared-use paths, unless indicated otherwise by traffic-control<br \/>\ndevices.<\/span><\/span><\/span><\/p>\n<p class=\"Justifications\">Specific justifications for \u00a7 11-505 changes:<\/p>\n<p class=\"Justifications\">The narrowness of most shared-use paths, and the slower<br \/>\ntravel speeds of bicycles compared with those of motor vehicles, make it more<br \/>\npractical and reasonably safe for pedestrians to keep to the right. This is the<br \/>\npractice in most states. Then bicyclists can at least keep moving at a slow<br \/>\nriding pace, or by walking. If pedestrians walk on the left, head-on conflicts<br \/>\nwith bicyclists occur and the capacity of the path is greatly reduced when it<br \/>\nis congested.
