According to David, Sen Frosh would vote for the bill with  the one word change in (C) (2) the failure to perceive constitutes a (substantial) GROSS deviation from the standard of care that would be exercised by a reasonable person.  However, David  indicated that the State&#8217;s Attorneys do not accept the change.&quot;<\/p>\n<p>So now we understand better why the support and then the lack of support has happened. Stay tuned while folks try to work this out but time is running out for legislative session (April 11, 2011.)<\/p>\n<p>(And lets hope this is not a case of covering ones rear end.)<br \/>\n<!--more--><br \/>\n********************************************************************<br \/>\nFrom Adiva Sotzsky, member of the Bike Maryland Task Force <\/p>\n<p>Following yesterday&#8217;s hearing, Senator Frosh said that he would support the bill if the wording regarding &#8216;substantial deviation&#8217; was changed to the model penal code&#8217;s terminology of gross deviation (which is not the same as gross negligence).<\/p>\n<p>Delegate Simmons made those adjustments to the bill &#8212; had it reviewed by the Attorney General&#8217;s office &#8212; and brought it to Frosh who said he would NOT support it.<br \/>\nThus Frosh is reneging on what he said he would do.<\/p>\n<p>Please contact your senators and members of the Judicial Proceedings Committee, etc. to contact Frosh to stand by\/fulfill his promises<br \/>\n    he asked for a change in wording so that he could\/would support the bill<br \/>\n    the change was made.
