font-size: small;\">Do<br \/>\nyou know that:<\/span><\/span><\/p>\n<ul>\n<li>\n<p class=\"western\" style=\"margin-bottom: 0in\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\">Under<br \/>\n\tcurrent law, drivers who, when <\/span><\/span><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\"><span style=\"text-decoration: underline;\">sober<\/span><\/span><\/span><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\"><br \/>\n\tused by any reasonable person and <\/span><\/span><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\"><span style=\"text-decoration: underline;\">cause<br \/>\n\tfatalities<\/span><\/span><\/span><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\">When<br \/>\n\tenacted, this law would establish a misdemeanor option for those who<br \/>\n\tcause fatalities by driving in a criminally negligent manner <\/span><\/span>\n\t<\/p>\n<\/li>\n<\/ul>\n<p class=\"western\" style=\"margin-bottom: 0in\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\"><b>Myths<br \/>\n&amp; Facts<\/b><\/span><\/span><\/p>\n<ul>\n<li>\n<p class=\"western\" style=\"margin-bottom: 0in\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\"><i>Maryland<br \/>\n\thas existing legislation that covers this offense  &#8211; Myth<\/i><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p class=\"western\" style=\"margin-left: 0.5in; margin-bottom: 0in\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\"><span style=\"text-decoration: underline;\">FACT<\/span><\/span><\/span><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\">:<br \/>\n\tThis bill establishes a standard of negligence that falls between<br \/>\ngross negligence (for conviction of manslaughter by vehicle) and of<br \/>\nsimple negligence\t<\/span><\/span><\/p>\n<ul>\n<li>\n<p class=\"western\" style=\"margin-bottom: 0in\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\"><i>The<br \/>\n\tdefinition of criminal negligence is vague &#8211; Myth<\/i><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p class=\"western\" style=\"margin-left: 0.5in; margin-bottom: 0in\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\"><span style=\"text-decoration: underline;\">FACT<\/span><\/span><\/span><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\">:\tCourts<br \/>\nhave found that the Model Penal Code&rsquo;s definition of negligence<br \/>\nis not unconstitutionally vague<\/span><\/span><\/p>\n<ul>\n<li>\n<p class=\"western\" style=\"margin-bottom: 0in\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\"><i>This<br \/>\n\tbill does not establish a standard that is meaningfully different<br \/>\n\tfrom existing law &#8211; Myth<\/i><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p class=\"western\" style=\"margin-left: 0.5in; margin-bottom: 0in\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\"><span style=\"text-decoration: underline;\">FACT<\/span><\/span><\/span><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\">:<br \/>\nCriminal Law Article &sect;2-209 requires proof of gross negligence<br \/>\nfor conviction. This is defined as &ldquo;wanton or reckless<br \/>\ndisregard for human life. This bill does not require that conduct be<br \/>\n&ldquo;extraordinary or outrageous&rdquo;.<\/span><\/span><\/p>\n<ul>\n<li>\n<p class=\"western\" style=\"margin-bottom: 0in\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\"><i>This<br \/>\n\tbill will impose penalties on drivers when there is a fatality as a<br \/>\n\tresult of simple negligence. &#8211; Myth<\/i><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p class=\"western\" style=\"margin-left: 0.5in; margin-bottom: 0in\"><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\"><span style=\"text-decoration: underline;\">FACT<\/span><\/span><\/span><span style=\"font-family: Arial, sans-serif;\"><span style=\"font-size: 11pt; font-size: small;\">:<br \/>\nThis bill requires that both the risk created by the person&rsquo;s<br \/>\naction and a deviation from the standard of care involved in the<br \/>\nfailure to perceive the risk be substantial.
