Driver to remain at scene &#8211; Accidents resulting in bodily injury or death.<\/b><\/span><\/a><\/p>\n<p><a rel=\"nofollow noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.michie.com\/maryland\/lpext.dll\/mdcode\/2617d\/27980\/27991?f=templates&amp;fn=document-frame.htm&amp;2.0#JD_tr20-104\"><span style=\"font-size: medium;\"><b>\u00a7 20-104. Duty to give information and render aid.<\/b><\/span><\/a><\/p>\n<p>As<br \/>\n far as I am concerned all the driver did was give information<br \/>\n(eventually) and failed in the other two requirements.&nbsp; <\/p>\n<p>I am outraged by the implication that cyclists are essentially in the same category as dead animal removal&#8230; just call the appropriate agency at your earliest convenience and that is the beginning and end of your duty. I will strongly assert a reasonable person would have (or should  have) in short order inspected such damage to their car and realized they hit a person (flat tire and dragging a bike for three miles is acceptable defense???) Assuming that it is valid to assert that one could not see a cyclist right in front of car headlights (which is not the same thing as asserting not being able to avoid hitting said cyclist.) <\/p>\n<p>So we have a supposedly an ongoing investigation but&nbsp; <\/p>\n<ul>\n<li>The police are already coming out in defense of the motorist<\/li>\n<li>Publicly misrepresenting the laws<\/li>\n<\/ul>\n<p>And this is not the first time, there is the <a rel=\"nofollow noopener noreferrer\" target=\"_blank\" href=\"https:\/\/onelesscar.org\/files\/public\/documents\/11-3-09%20Resolution%20and%20Cover%20Letter%20to%20Maryland%20State%20Police.pdf\">MBPAC October 2009 resolution <\/a> about <a href=\"https:\/\/www.baltimorespokes.org\/article.php?story=200910061721167\"> St. Mary&#8217;s fatality.<\/a><\/p>\n<p><a href=\"https:\/\/www.baltimorespokes.org\/article.php?story=2010100120254654\">Yoram Kaufman&#8217;s fatality<\/a> (also in PG County.)<\/p>\n<p>And there is the <a rel=\"nofollow noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.baltimorespokes.org\/article.php?story=20100304093907245\">Jack Yates fatality<\/a>. I assumed once the video showed up showing that in fact the truck did not signal its turn that would go in favor of the cyclists, then we got this response from the police:<a rel=\"nofollow noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.baltimorespokes.org\/article.php?story=20090820231731405\"><\/a><\/p>\n<hr style=\"width: 100%; height: 2px;\" \/><span style=\"font-style: italic;\">I am the commander of the Traffic Section within the Baltimore Police<br \/>\nDepartment.  I supervise the Crash Team and therefore the e-mail you<br \/>\nauthored to Mayor Sheila Dixon was forwarded to me for a response.<\/span><br style=\"font-style: italic;\" \/><br \/>\n<br style=\"font-style: italic;\" \/><span style=\"font-style: italic;\"><br \/>\nI was at the scene of this tragic crash and I know that this incident<br \/>\nwas investigated thoroughly from the very beginning as a very serious<br \/>\nissue, as all fatal crashes are.  We have obtained a video of this<br \/>\nincident  that shows the entire event. <\/span><br style=\"font-style: italic;\" \/><br \/>\n<br style=\"font-style: italic;\" \/><span style=\"font-style: italic;\"><br \/>\nThere are only some aspects of this case that are public record.  I will<br \/>\n tell you that the video clearly shows the cyclist to be at fault.<br \/>\nThere is no &#8220;right to the road&#8221; as a cyclist.  <span style=\"font-weight: bold;\">You have the same rights<br \/>\nas a motor vehicle and also the same obligations.<\/span>  The cyclist was not<br \/>\noperating within those parameters.  The  tanker truck that the cyclist<br \/>\nstruck was a large one.  The cyclist struck it in the rear.  There is no<br \/>\n evidence to support that the driver was ever aware there was an impact.<br \/>\n  Do not believe what the media reports as entirely true regarding this<br \/>\nor any event. <\/span><br style=\"font-style: italic;\" \/><br \/>\n<br style=\"font-style: italic;\" \/><span style=\"font-style: italic;\"><br \/>\nThe investigators within the unit are very educated and experienced in<br \/>\nall types of crashes and have attended several schools specific to the<br \/>\nphysics of a pedestrian crash and a cyclist fatal crash.  With regard to<br \/>\n the question of it being investigated as a hit and run accident, not<br \/>\nonly was it investigated as such but the truck was located by<br \/>\ninvestigators within a few days of the incident. <\/span><br style=\"font-style: italic;\" \/><br \/>\n<br style=\"font-style: italic;\" \/><span style=\"font-style: italic;\"><br \/>\nPlease feel free to contact my office if you have any further questions. <\/span><br style=\"font-style: italic;\" \/><br \/>\n<br style=\"font-style: italic;\" \/><span style=\"font-style: italic;\"><br \/>\nLt. Seriously? It&#8217;s illegal to ride in a parking lane? No way would such a ticket hold up if there was no accident, ah but if there was an accident so now the behavior is illegal, so the rule is where ever a cyclists was when a crash occurred if we can make up something that says he could have been somewhere else then the cyclists is at fault.
