Among other things, cyclist in Maryland will no longer be required to use the shoulder just because one is present. And while criminally negligent driving that results in a death won&#8217;t be a misdemeanor, negligent driving that results in a death may result in a &#36;1000 fine and a 180 suspension of a driver&#8217;s license.<\/p>\n<blockquote>\n<p><span style=\"font-family: Arial;\">SB 189, suspension of driver&#8217;s license for<br \/>\nreckless or<br \/>\nnegligent driving that leads to a fatality:&nbsp; Passed.<\/span><\/p>\n<div><span style=\"font-family: Arial;\"><a href=\"https:\/\/mlis.state.md.us\/2010rs\/billfile\/sb0189.htm\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/mlis.state.md.us\/2010rs\/billfile\/sb0189.htm<\/a><\/span><\/div>\n<div>&nbsp;<\/div>\n<div><span style=\"font-family: Arial;\">HB 282, Declaring that it is the policy of the<br \/>\nState that<br \/>\nthe Maryland Department of Transportation shall work to ensure that<br \/>\nthere is an<br \/>\nappropriate balance between funding for specified transportation<br \/>\nprojects for<br \/>\npedestrians and bicycle riders and specified highway construction<br \/>\nprojects and<br \/>\nplace increased emphasis on specified transportation projects:&nbsp;<br \/>\nPassed.<\/span><\/div>\n<div><span style=\"font-family: Arial;\"><a href=\"https:\/\/mlis.state.md.us\/2010rs\/billfile\/HB0282.htm\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/mlis.state.md.us\/2010rs\/billfile\/HB0282.htm<\/a><\/span><\/div>\n<div>&nbsp;<\/div>\n<div><span style=\"font-family: Arial;\">SB 624, removing the mandate that bicyclists<br \/>\nride on a<br \/>\nshoulder when one is present and allowing a bicyclist to cross a street<br \/>\nin a<br \/>\ncrosswalk when riding on the adjacent sidewalks is legal, and requiring<br \/>\nvehicle<br \/>\ndrivers to yield to cyclists in a crosswalk:&nbsp; Passed.<\/span><\/div>\n<div><span style=\"font-family: Arial;\"><a href=\"https:\/\/mlis.state.md.us\/2010rs\/billfile\/SB0624.htm\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/mlis.state.md.us\/2010rs\/billfile\/SB0624.htm<\/a><\/span><\/div>\n<div>&nbsp;<\/div>\n<div><span style=\"font-family: Arial;\">SB 870, Making it a misdemeanor for a person to<br \/>\ncause the<br \/>\ndeath of another as a result of the person&#8217;s driving, operating, or<br \/>\ncontrolling<br \/>\na vehicle or vessel in a criminally negligent manner:&nbsp; Failed.<\/span><\/div>\n<div>\n<p><span style=\"font-family: Arial;\"><a href=\"https:\/\/mlis.state.md.us\/2010rs\/billfile\/sb0870.htm\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/mlis.state.md.us\/2010rs\/billfile\/sb0870.htm<\/a><\/span><\/p>\n<\/div>\n<\/blockquote>\n<p>The last bill is the three feet passing bill. As <a href=\"https:\/\/www.thewashcycle.com\/2010\/04\/maryland-likely-to-pass-3-foot-passing-law-others.html?cid=6a00d8345198c369e20133ec7f1b6e970b#comment-6a00d8345198c369e20133ec7f1b6e970b\">Contrarian points out<\/a> it&#8217;s pretty weak. I don&#8217;t agree that it makes things worse because of part 1 that still requires due care. But the exceptions make it worthless beyond the <a href=\"https:\/\/weblogs.baltimoresun.com\/news\/traffic\/2010\/04\/bicyclists_weigh_in_on_3foot_r.html\">symbolism<\/a>. There is now a <a href=\"https:\/\/mlis.state.md.us\/2010rs\/bills\/sb\/sb0051e.pdf\">3 feet law<\/a>, but it has no teeth.<\/p>\n<blockquote>\n<p>(a) Notwithstanding any other provision of this title, the driver of a vehicle shall<\/p>\n<p>(1) Exercise due care to avoid colliding with any bicycle, EPAMD, or motor scooter being ridden by a person; AND <br \/>(2) WHEN OVERTAKING A BICYCLE, AN EPAMD, OR A MOTOR SCOOTER, PASS SAFELY AT A DISTANCE OF NOT LESS THAN 3 FEET, UNLESS, AT THE TIME:<\/p>\n<blockquote>\n<p><span id=\"comment-6a00d8345198c369e20133ec7f1b6e970b-content\"><em>(I) THE<br \/>\n BICYCLE, EPAMD, OR MOTOR SCOOTER RIDER FAILS TO OPERATE THE VEHICLE IN<br \/>\n CONFORMANCE WITH \u00a7 21\u20131205(A) OF THIS SUBTITLE (\u201cRIDING TO RIGHT SIDE<br \/>\nOF ROADWAY\u201d) OR \u00a7 21\u20131205.1(B) OF THIS SUBTITLE (\u201cROADWAY WITH BIKE<br \/>\nLANE OR SHOULDER PAVED TO SMOOTH SURFACE\u201d); OR <br \/>\n(II) A PASSING CLEARANCE OF LESS THAN 3 FEET IS CAUSED SOLELY BY THE<br \/>\nBICYCLE, EPAMD, OR MOTOR SCOOTER RIDER FAILING TO MAINTAIN A STEADY<br \/>\nCOURSE.<\/em><\/span><\/p>\n<p><span id=\"comment-6a00d8345198c369e201347fd4856f970c-content\">(III) THE<br \/>\nHIGHWAY ON WHICH THE VEHICLE IS BEING DRIVEN IS NOT WIDE ENOUGH TO LAWFULLY PASS THE BICYCLE, EPAMD, OR MOTOR SCOOTER AT A DISTANCE OF AT LEAST 3 FEET.<\/span><\/p>\n<\/blockquote>\n<\/blockquote>\n<p><span>So if the lane [Law says Highway, which is all lanes] is too narrow for safe passing, you can go ahead and pass in an unsafe manner. I&#8217;d like to see LAB not give them credit for this poor law. This is not a three feet passing law. It&#8217;s a sham. Though I do like that the MSM is reporting it without caveats. It helps if <a href=\"https:\/\/www.wtop.com\/?nid=25&amp;sid=1933856\">people believe<\/a> they always have to give three feet. <br \/><\/span><\/p>\n<blockquote>\n<p><span class=\"nonprint\">Legally, bikes do have a right to the roadways,<br \/>\nin most cases in most jurisdictions. Those rights have been expanded in<br \/>\nD.C. and Maryland where a 3-foot rule has been passed. That rule directs<br \/>\n drivers to give cyclists a 3-foot buffer.
