The bill (CB-10-<span style=\"color: black;\">2009,<br \/>\nsee attached file),<\/span> introduced by Tony Knotts,&nbsp;would keep trail<br \/>\neasements from being created on \u201cindividually residentially zoned<br \/>\nlots\u201d and place severe restrictions on building trails on existing<br \/>\neasements. Restrictions would include having the trail open to the public only<br \/>\nbetween 9 am and 4 pm, gating the trail when it is not open to the public, and<br \/>\nhaving M-NCPPC Park Police man security posts every 1,000 feet. <\/p>\n<\/div>\n<div>\n<p class=\"MsoNormal\">&nbsp;<\/p>\n<\/div>\n<div>\n<p class=\"MsoNormal\">Trail easements are frequently established as a condition<br \/>\nfor the approval of new subdivisions, and they are an important way to expand<br \/>\nour future trail system. We need to inform the County Council that the<br \/>\neasements are an important element of the County&#8217;s overall policy for improving<br \/>\nbicycle and pedestrian access.<\/p>\n<\/div>\n<div>\n<p class=\"MsoNormal\">&nbsp;<\/p>\n<\/div>\n<div>\n<p class=\"MsoNormal\">The March 18 committee meeting (see attached agenda) will be<br \/>\nat&nbsp;<span style=\"color: black;\">10 am, Room 2027, County Administration<br \/>\nBuilding. Committee meeting are open to the public, but usually there is no<br \/>\npublic comment period. If the committee goes along with the bill, there will be<br \/>\na&nbsp; public hearing later and then the vote by the entire council. Before<br \/>\nnext Wednesday\u2019s committee meeting, we need to have people&nbsp;e-mail,<br \/>\nwrite or phone committee members asking them to oppose this bill and any other<br \/>\nattempts to deny the public use of public trail easements.<\/span><\/p>\n<\/div>\n<p><!--more--><br \/>\nIf you live in the district of one of the committee members, it is especially important for you to let your council member know that you oppose the bill.<\/p>\n<p>PZED Committee Members:<br \/>\n<br \/>\nSamuel H. BE IT ENACTED by the<br \/>\nCounty Council of Prince George&#8217;s County, Maryland, that Section<br \/>\n24-123 of the Prince George&#8217;s County Code be and the same is hereby<br \/>\nrepealed and reenacted with the following amendments:<\/p>\n<p style=\"margin-bottom: 0in; text-align: CENTER;\"><b>SUBTITLE 24.<br \/>\nSUBDIVISIONS.<\/b><\/p>\n<p style=\"margin-bottom: 0in; text-align: CENTER;\"><b>DIVISION 4.<br \/>\nREQUIREMENTS: TRANSPORTATION AND CIRCULATION.<\/b><\/p>\n<p style=\"margin-bottom: 0in\"><b>Sec. 24-123.  General requirements.<\/b><\/p>\n<p style=\"margin-bottom: 0in; widows: 2; orphans: 2; text-align: JUSTIFY;\">\t(a)\tThe<br \/>\nPlanning Board shall require that plats conform to the following:<\/p>\n<p style=\"margin-bottom: 0in; widows: 2; orphans: 2; text-align: JUSTIFY;\">\t\t(1)\tThe<br \/>\nrights-of-way of all highways, streets, and transit facilities shown<br \/>\non the General Plan, functional master plans, and area master plans<br \/>\nshall be shown on the preliminary plat and, when reserved or<br \/>\ndedicated, shown on the final plat.<\/p>\n<p style=\"margin-bottom: 0in; widows: 2; orphans: 2; text-align: JUSTIFY;\">\t\t(2)\tAll<br \/>\nproposed streets shall be continuous and in alignment with existing<br \/>\nor platted streets in adjoining subdivisions so as to create a street<br \/>\nnetwork that is functional and easily understandable.  Generally,<br \/>\nstreets should cross other streets at right angles.<\/p>\n<p style=\"margin-bottom: 0in; widows: 2; orphans: 2; text-align: JUSTIFY;\">\t\t(3)\tAll<br \/>\ninternal subdivision streets shall be wholly within the County and<br \/>\nshall not be designed to directly connect to an adjacent county<br \/>\nunless the applicant has obtained the prior written approval of the<br \/>\nDistrict Council and the appropriate land use authority of the<br \/>\nadjacent County.<\/p>\n<p style=\"margin-bottom: 0in; widows: 2; orphans: 2; text-align: JUSTIFY;\">\t\t\t(A)\tAn<br \/>\napplicant must file a written request for said approval.  The request<br \/>\nshall be filed with the Clerk of the District Council.  The District<br \/>\nCouncil must either approve or disapprove said request within<br \/>\nforty-five (45) days from the date of filing.  Failure of the<br \/>\nDistrict Council to act within said forty-five (45) day period shall<br \/>\nconstitute an approval of the request.  For purposes of this<br \/>\nprovision an internal subdivision street shall be deemed to be a<br \/>\npublic roadway having a right-of-way width of eighty (80) feet or<br \/>\nless.<\/p>\n<p style=\"margin-bottom: 0in; widows: 2; orphans: 2; text-align: JUSTIFY;\">\t\t\t(B)\tAfter<br \/>\npublic hearing before the District Council, the Council shall not<br \/>\nallow the proposed bi-county subdivision unless it finds that<br \/>\ndelivery of public safety services, utility services, and tax<br \/>\ncollection will be timely and adequate for the lots in Prince<br \/>\nGeorge&rsquo;s County.<\/p>\n<p style=\"margin-bottom: 0in; widows: 2; orphans: 2; text-align: JUSTIFY;\">\t\t(4)\tAll<br \/>\nstreets proposed for dedication to public use shall be designed to<br \/>\nthe standards of the County road ordinance and street standards for<br \/>\nwidth and minimum curve radii or to the standards of municipalities<br \/>\nhaving jurisdiction.  Variations from these standards may be granted<br \/>\nby the Planning Board upon the recommendation of the Department of<br \/>\nPublic Works and Transportation or upon the recommendation of the<br \/>\nmunicipality or other governmental authority having jurisdiction.<\/p>\n<p style=\"margin-bottom: 0in; widows: 2; orphans: 2; text-align: JUSTIFY;\">\t\t(5)\tArterial<br \/>\nhighways shall have a minimum right-of-way width of one hundred and<br \/>\ntwenty (120) feet; collector streets, a minimum right-of-way width of<br \/>\neighty (80) feet; and parkways, such right-of-way width as may be<br \/>\ndesignated by the Planning Board.  The width of secondary subdivision<br \/>\nstreets shall be not less than fifty (50) feet and the width of<br \/>\nprimary subdivision streets not less than sixty (60) feet.<\/p>\n<p style=\"margin-bottom: 0in; widows: 2; orphans: 2; text-align: JUSTIFY;\">\t\t(6)\tLand<br \/>\nfor bike trails and pedestrian circulation systems shall be shown on<br \/>\nthe preliminary plat and, where dedicated or reserved, shown on the<br \/>\nfinal plat when the trails are indicated on a master plan, the County<br \/>\nTrails Plan, or where the property abuts an existing or dedicated<br \/>\ntrail, unless the Board finds that previously proposed trails are no<br \/>\nlonger warranted.  <span style=\"text-decoration: underline;\">Notwithstanding the above, an easement for bike<br \/>\ntrails and pedestrian circulation systems shall not be created on<br \/>\nindividual residentially zoned lots.<\/span><\/p>\n<p style=\"margin-bottom: 0in\">\n<\/p>\n<p style=\"margin-bottom: 0in\">\t\t<span style=\"text-decoration: underline;\">(7)<\/span>\t<span style=\"text-decoration: underline;\">Bike trails and<br \/>\npedestrian circulation systems constructed on easements held on<br \/>\nresidentially-zoned property shall comport with the following<br \/>\nrequirements:<\/span><\/p>\n<p style=\"margin-bottom: 0in\">\t\t\t<span style=\"text-decoration: underline;\">(A)<\/span>\t<span style=\"text-decoration: underline;\">Landowners within<br \/>\none-half mile of the subject residential property for the proposed<br \/>\ntrail must be notified via first-class mail of the pending<br \/>\nconstruction of the trail.  The notice shall contain a list of<br \/>\nsubject properties on which the proposed trail will be situated, as<br \/>\nwell as the date for the public hearing.  Signs notifying the public<br \/>\nof the proposed bike trail shall be posted on the subject property<br \/>\nand shall comport with the requirements of Section 27-125.03 of the<br \/>\nZoning Ordinance;<\/span><\/p>\n<p style=\"margin-bottom: 0in\">\t\t\t<span style=\"text-decoration: underline;\">(B)<\/span>\t<span style=\"text-decoration: underline;\">Upon thirty (30) days<br \/>\nnotice, a public hearing shall be held before the Planning Board on<br \/>\nthe proposed bike trail and pedestrian circulation system.  At the<br \/>\nconclusion of the public hearing, the record shall remain open for a<br \/>\nperiod of fifteen (15) days to allow for public comment on the<br \/>\nproposed bike trail and pedestrian circulation system;<\/span><\/p>\n<p style=\"margin-bottom: 0in\">\t\t\t<span style=\"text-decoration: underline;\">(C)<\/span>\t<span style=\"text-decoration: underline;\">On the portions of the<br \/>\ntrail constructed employing easements on residential property, manned<br \/>\nsecurity posts shall be provided at intervals of every one thousand<br \/>\n(1,000) feet.  The posts shall be manned by members of the<br \/>\nMaryland-National Capital Park and Planning Commission Park Police;<\/span><\/p>\n<p style=\"margin-bottom: 0in\">\t\t\t<span style=\"text-decoration: underline;\">(D)<\/span>\t<span style=\"text-decoration: underline;\">Locking barriers shall<br \/>\nbe provided at the beginning and end of each residential area on<br \/>\nwhich trails are constructed on easements on residential property.<br \/>\nThe barriers shall be locked during all hours the trail is not open<br \/>\nto the public; and<\/span><\/p>\n<p style=\"margin-bottom: 0in\">\t\t\t<span style=\"text-decoration: underline;\">(E)<\/span>\t<span style=\"text-decoration: underline;\">Trails constructed on<br \/>\neasements on residential property shall be open to the public between<br \/>\nthe hours of 9 a.m. and 4:00 p.m. daily.    <\/span>\n<\/p>\n<p style=\"margin-bottom: 0in\">\tSECTION 2. BE IT FURTHER ENACTED that<br \/>\nthis Act shall take effect thirty (30) calendar days after it becomes<br \/>\nlaw.<\/p>\n<hr \/>\n<p style=\"margin-bottom: 0in\"><span style=\"font-family: Arial,Bold,;\"><span style=\"font-size: 11pt;
